Oh, &$%#! Here’s another one.

I’m finally back in the States and trying to solve my issues with Fred Thompson’s people. In doing so, I did a Google search on ‘FredCast’ and came up with yet another podcast-type use at Fredericksburg.com.

But wait! Here’s yet another one!

Okay, folks, I seriously need an attorney who understands intellectual property. One or more of you FredCast listeners must be an attorney. Please contact me!

  2. I’m not sure what the problem is. Who cares if other people are calling it the same thing for similar reasons? Podcasting and the internet are free and open-source. It’s not like they’re podcasting on cycling. More than 1 company can register or trademark or whatever the same name as long as they’re in 2 different businesses.

    It’s great that you want to make money off your podcasting efforts (thanks, by the way, your podcasts are great!) but part of the reason people like your podcasts is because you appear genuinely sincere and not out to make a buck. Sure this website, bandwidth, socks, etc cost money but the second people think you’re getting too commercialized they’ll know that this isn’t a hobby for you anymore and will listen to the next Fred that makes podcasting their hobby.

    Stay real.

  3. Damn, man, the guy’s 1st name is FRED. The city’s name is FREDricksburg. They have more rights to use the term Fred than you do. It’s their name,David. Helllooooooo!

  4. The term I am upset about isn’t Fred. It isn’t Fredericksburg, or Fred Thompson or Fred Flintstone. It is FredCast. A term specifically used for a podcast and one which I’ve used for two years.

    And by the way, three comments within 15 minutes all from the same person at the same IP address isn’t cool. If you have something to say, once is enough.

    My brother (a fred to the 10th degree) is an intellectual property attorney here in Salt Lake City and works for the largest and best IP firm in the region. I am sure he would love to help you out! Drop me a line if you are interested.

  7. David, me thinks you protest too much. It’s only an amateur podcast name, this is not MacDonalds, What are your motives? The Fredcasts are getting more and more commercial. I’ve been listening since the early days and I’ve noticed a definite shift in direction in the last 6 months. Don’t get all corporate on us, Fredcast is about chatting to other guys who get a buzz out of riding bikes – no more.

  8. Huh? What are you posters talking about. There is value in names. You have to protect them. Fredcast is a name and it indeed hs value, just exactly like McDonalds or Coke. David would be nuts not to pursue his right to teh name. And it IS conusing, it’s another podcast with the same name. If there was a Fredcast fishing pole that might be different, but you can’t build a brand if others use your name.
    David, I hope you work out something with Carl’s brother. In teh meantim, get the darn name trademarked if you haven’t already!

  10. We’re the listeners of the 3 comments posted above. Sorry but all 3 of us think you’re going a little too far with this FredCast trademark thing and agree with one of the posters below that said about cooling it. Are you trying to make money off us or is this a grass-roots podcast effort because it certainly used to be in the early podcasts and that’s what got us hooked.

    Maybe you should change your name to TheFredCast instead of FredCast or maybe PhredCast (works for Cisco and Sysco – 2 different companies that do 2 different things just like you, Fredricksburg and that politician guy).

    Next time we’ll wait till we get to work before posting so you can have 3 different IP’s 🙂

    Once again, you’ve posted without a valid email address, something I simply don’t understand. If you believe in your comments, then give me a chance to respond to you personally. Attacks from anonymous individuals carry far less weight as far as I’m concerned.

    I’m sorry you feel so strongly that I am doing the wrong thing, but the people with the Fred Thompson campaign obviously thought I was correct since they agreed to change their name.

    As for ‘trying to make money off ‘ my listeners, you need to understand that I oftentimes spend as much time on The FredCast as I do at my full-time job. This takes time away from my family, my riding, sleep, and other important pursuits. When I travel to the Tour of California, Interbike, and other places for The FredCast, the money comes out of my pocket. Why shouldn’t I be allowed to have sponsors and advertisers? I do love doing The FredCast, but I can’t continue to do so without a form of support for the show.

    If you can’t understand that, then I will understand if you decide not to listen.
